Digital Image & Intellectual Property Policy

All original photography, text, and visual content created by Danielle Mosier Photography & Design LLC —whether displayed on this website, social media, client proofing galleries, or external sales platforms—is the exclusive intellectual property of Danielle Mosier Photography & Design LLC. Under intellectual property laws, ownership rights are automatically established the moment an image is created, regardless of whether a formal copyright has been registered. This policy outlines the rules regarding the use of my digital assets across all platforms.

1. Ownership of Work

All images I create belong to Danielle Mosier Photography & Design LLC. They are not royalty-free, and they are not in the public domain. The purchase of a physical print or a digital file through any of my sales platforms provides you with a license to enjoy that image, but it does not transfer the underlying ownership rights to the buyer unless a specific, written commercial buyout agreement is signed.

2. Prohibited Uses (Digital Theft)

Unauthorized use of any image from my website, public profiles, or private client galleries constitutes digital theft. You may not, under any circumstances:

  • Screenshot, download, or save un-purchased preview images or proofs from client galleries and sales platforms.
  • Remove, crop, or alter watermarks. Removing a watermark from a preview image is a direct violation of the Digital Millennium Copyright Act (DMCA).
  • Edit or alter the images in any way (including applying Instagram or third-party filters to purchased or shared images).
  • Use the images for commercial purposes (e.g., on business websites, in marketing materials, on business social media accounts) without purchasing a specific commercial license.
  • Claim the work as your own or submit it to contests or publications without permission.

3. Permitted Uses & Sharing

We appreciate when you share our work, provided it is done legally and respectfully. You are welcome to:

  • Share links to my official website, public galleries, or social media posts.
  • Share purchased or explicitly provided images on personal social media accounts, provided clear, clickable credit is given to @dmosierphoto in the primary caption.
  • Use native "Share" or "Repost" tools on social media platforms that automatically link back to my original post.

Note: Vendor and commercial sharing requires prior written consent or a vendor licensing agreement.Sample text. Click to select the Text Element.

4. Enforcement and Consequences

Digital theft actively harms independent artists. I monitor the web and social media for unauthorized use of my photography and enforce my intellectual property rights strictly.

If an image is found being used without permission:

  1. Retroactive Invoicing: Unauthorized commercial or uncredited use will be invoiced for retroactive licensing at 3x the standard commercial rate. If watermarks, meta-data, or copyright notices have been deliberately removed or altered, the retroactive fee increases to 5x the standard rate in addition to potential statutory damages under the DMCA.
  2. Content Takedowns: I will file formal takedown notices with the relevant website host, internet service provider, or social media platform, which may result in a strike against your account or the suspension of your website.
  3. Legal Action: Failure to pay retroactive fees or remove the stolen images may result in formal legal action to recover damages.

5. How to Legally Purchase or License Images

If you would like to use my images for your business, blog, or publication, or if you want to purchase full-resolution, un-watermarked versions of gallery images, please utilize my official sales platforms or contact me directly.
